Reference is made to the Planning Authority’s statement regarding the new road being built by Infrastructure Malta in Dingli. Ironically, the PA’s statement is confirming, black on white, that Infrastructure Malta needs a planning permit for this road.
The PA is trying to justify the building of this new road without planning permits, citing a Legal Notice allowing “schemed roads” in Local Plans to go ahead without such permits. However, as can clearly be seen in the Local Plan for the area, the road Infrastructure Malta wants to build does not match with the schemed road in the Local Plan.
It is clear that the schemed road, as drawn in the Local Plan, does not go beyond the ODZ line (white part beyond red line). However, the road Infrastructure Malta wants to build will take up ODZ land. This means that they came up with a street alignment that is inexistent within the Local Plan, making a planning permission necessary.
Qed nagħmlu referenza għall-istqarrija tal-Awtorità tal-Ippjanar fir-rigward tat-triq il-ġdida li qed tinbena minn Infrastructure Malta f’Ħad-Dingli. Ironikament, l-istqarrija tal-Awtorità tal-Ippjanar qed tikkonferma, iswed fuq l-abjad, li Infrastructure Malta għandha bżonn permess tal-ippjanar sabiex tibni din it-triq.
Il-PA qed tipprova tiġġustifika l-bini ta’ din it-triq mingħajr permessi tal-ippjanar billi tirreferi għal Avviż Legali li jħalli “toroq skemati” fil-Pjan Lokali isiru mingħajr dawn il-permess. Iżda, kif jidher b’mod ċar mill-Pjan Lokali għal dik iż-żona, it-triq li trid tibni Infrastructure Malta ma taqbilx mat-triq skemata fil-Pjan Lokali.
Huwa ċar li t-triq skemata, kif iddisinjata fil-Pjan Lokali, ma tmurx lil hinn mill-linja tal-ODZ (il-parti l-bajda wara l-linja l-ħamra). Iżda t-triq li trid tibni Infrastructure Malta se tieħu art ODZ. Dan ifisser li huma ħolqu allinjament tat-triq li ma jeżistix fil-Pjan Lokali, u għalhekk permess tal-ippjanar huwa meħtieġ.
